Something similar happened to my husband. He was working for a company that repeatedly wrote him bad paychecks and finally one day he went to work and they had packed up and left. They hadn't said a word to any of the employees!!! We ended up going to the State Comptroller and they tracked down the former employer. They garnished the back pay from a new business account that had been opened in another city. It took a couple of months, but one day we received a check in the mail for all of the back pay.

This happened to me. You can either file a complaint with the State Board and hope they take action, or if the amount is for less than $7,500 then you can sue your employer in small claims court.

I sued my employer and won a judgement, but I was never able to collect on it. Be aware that collecting on a judgement, especially from entities that can easily hide or shift funds, can be an arduous proposition.

Mostly, the thing to do is to chalk it up as an expensive lesson in life and move on. Find another job fast, and be careful who you work for. Good luck.

Note - the first thing I did was request a replacement check from the CEO. He said no. Turns out, my situation was relatively trivial - he actually had stolen millions from investors and eventually left the country.

Contact your employer; if that doesn't work, you will probably need to contact your state department of labor. Governments and the courts tend to take a VERY dim view of employers who don't pay people for the work they do. You should NOT have to wait for another pay period to go by to get paid; you are owed the money immediately, according to whatever workplace policy your employer has set.

Demand immediate payment in cash. If not received report it to the police--it is larceny by check.
