A company in nyc has located my family but i am not the executor, administrator. however, they guaranteed 18 months and now its been 26 and no end in sight to finish it up. They have a lawyer working for them but he says I do not have standing to arbitrate his fee. I live in another state but I would like to find out if this is true. julianne2saw@yahoo.com

If you are a named beneficiary of the will you would have a right to review any statement for fees incurred by the estate for the purposes of handling the estate. Whether or not you are in a position to file a claim for arbitration is dependent on the state in which you live. However, if you feel the fees are excessive you may have recourse through the court that has entered orders regarding the estate. Most courts have to approve fees paid to the person handling the estate. If no one raises an issue the fees will probably be paid without issue. Consult an attorney in NYC to determine exactly what your legal rights in that jurisdiction may be.
