O.K. I misworded the question. WHO appointed him? Does anyone except the judge that appointed him have any say over who it is?

Judge Seidlin also appointed Miami lawyer Richard Milstein to represent Dannielynn's interests in the local court, a move that raised objections from lawyers for Smith's mother as well as her longtime partner, Howard Stern.

As Dannielynn's guardian ad litem, Mr Milstein said he's seeking two things for the child: to ensure a place where she can visit her mother's grave, and to make sure she never has to know about the media and legal tussle over her life.

The battle for custody of Ms Smith's body will continue and an evidentiary hearing is scheduled for Tuesday. Her body will be kept refrigerated at the Medical Examiner's office. Attorney Richard Milstein was appointed a guardian to protect Ms Smith's five-month-old daughter, Dannielynn's, interest.

I think the technical term is guardian ad litem. This is a person appointed by the court to look out for the best interests of the child during the course of legal proceedings. Since children (especially a 5 month old) can't participate in their own legal proceedings, they need an impartial person to act in the best interest of the child.

Stern appointed a guardian for the baby since he is in the middle of a battle over who the father is. Stern made sure the baby's lawyer wanted to the same thing stern wanted..Stern is a lawyer and is playing the game like a lawyer to get his way.

I'm sure that the judge heard the evidence and thought that this was the right decision to make. Ask the judge who heard the evidence.
