Hi - have been divorced for 1 year now and still use my married name as I have kids and its seemed the easiest option. is it illegal to keep the identity ? My reason for asking is that I would like to apply for a renewed passport in my married name even though Im not married. Am quite happy to change back to maiden name if necessary . Thanks in adance

No, it's not illegal. Even if your maiden name was legally restored to you in your divorce decree, you can use your married name as long as you want. I moved countries after my husband and I split and kept his name for several years because all my legal documents were in my married name. The only reason I went back to my maiden name in the end (like 12 years later) is because I had a child and didn't want him to have my ex-husband's surname.

If you had your maiden name restored after the divorce, then everything needs to be changed. if you kept your married name, then just change the passport.
