my son is disabled i meant his benefits to cover the mortgage on the buy to let for him , his council property could go to someone else!

Technically, rents paid to a relative is not payable by council or benefit office. However, you could form a trust which buys the house to let it to your son. The trust would be a limited company and so the landlord is the limited company whose directors are trustees. Your son can now claim full rent from council/benefit office and pays this over to the trust.

It is possible but hard work initially if you have limited knowledge about trust and all that!!

That's right, why not remove another house from the market so people with jobs have to continue renting!

I believe benefits only pay the interest on a mortgage anyway. Perhaps your son could get a job?

His rent would be classed as income and he would lose his benefits. The relevant information could be withheld but it's a jail job if you are caught.
If you let the property to your son, again his benefits would stop because of the family connection.

I dont think this is legal. We were thinking of moving from our home and letting it to a family member who was on benefits as they were in a small home and ours is quite big. But we were advised by a financial advisor that this was not acceptable as we were related.

i cant see why not, it'll mean your his landlady the same as anyone else he rents from but i would phone your local benefits office just to make sure
