I have a claim against my ex employer for unfair dismissal and have just realised i have been paid the wrong o/t rate for 3.5 years claim I claim the shortfall in pay?

The responded to my claim that my working hours were 40 per week. When I checked my contract of employment it stated 40 per week. Hours 9-6 with 1 hrs unpaid lunch a day. But my overtime has always been worked that I worked 45 hours per week. Therefore o/t rate has been short a large sum of money over 3.5 yrs. Also just moticed thay have different norice period for clerical staff - 1 months notice and Drivers 1 week for every complete year. Can they discriminate? I was paid monthly

Yes you have six years in which to legally start action for money owed to you. However you prob cant put it in with your unfair dismissal claim as this is already in progress, and your pay would be a different matter. if youve got a claim in already, dont expect to get your money back easily either.

Get on to your union rep, if your not in a union join one.

you need to speak to your ACAS rep for that answer but it could go in your favour
