We were married 20 years and she was awarded $2,000/ mo. (my income is very good). In Mo. where the decree was issued and where we both live the maintenance lasts until one of us dies or she remarries. She is 61 and in good health. She does not date and has no interest in men. I have already taken her to court (4 years ago) and sought to modify or eliminate it. After a trial the judge (female) ruled in her favor. Any suggestions on how to get out of this spot. And, I have already seen two lawyers and gotten their perspective on it.

Well if she is not interested in men this is just a thought..Maybe you could hook her up with a female bring them to a state that will marry them..Like I said it was just a thought if that doesn't work then until a judge says you do not have to pay her then you are stuck sorry..

You already know what the law says about it, the judge has already ruled to enforce the law upon attempted modification, you don't get to end it unless she dies or remarries.

I work for a lawyer, and he generally will not even entertain the thought of taking a case like this. If you came into our office to discuss this matter, he would flat out tell you he could not take your money with a clear conscience, knowing that there was no way in hell of you winning this battle.

If you've already seen two lawyers and gotten their perspectives on it, then they must agree with the ruling.

The decree is a legally binding document that you must adhere to. If it says the maintenance lasts until one of you dies or she remarries, then that's how long it will last.

I need to know. Was your ex wife given the chance to go back to school and get her degree? If she has a degree then her free loading butt needs to go back to work. The next time you go up in front of a judge (sex shouldn't matter), point out that their are jobs out there that she can make at least $1500 a month. You shouldn't have to pay for her just so she can maintain the lifestyle she was accustomed to during the time you guys were married.

Did you even point out all the bills you two acquired while you were married -- credit cards, car payments, house notes, etc. If you paid for all of it then make a note of that and present it, and try to have that reduced from the total you have to pay each month.

You need to sit down and do simple math. Figure out how much you will have to pay until she turns 78 (which is the avg. life exp. of a female in the US), and subtract that from how much you have paid for stuff while you were married.

In today's world where both man and women are expect to work to pay bills, figure out what she would have to pay to you each month in alimony. If she would have to pay you $500 (again simple math), then subtract that from $2000. What was good for the marriage making everything 50/50 then the divorce should be the same.

Why does it matter that the judge was a female?

Alimony is usually paid because the court determines the spouse gave up or never started a career in order to help you in yours, by taking care of the house or kids so you didn't have to. If she did that, she deserves the money.

If you won't miss the 2g's I'd leave it be. You two were married for 20yrs. You didn't mention why it ended, so I assume the judge came up with that ruling for a couple of grand reasons. She gave you 20yrs of her life and you gave her twenty of yours. Now think about it, Ya think the 2g's is enough? Be grateful she isn't taking you to court for rising cost of living expenses.

If you can afford it don't let it take over your life. It's hard to live on $2000 a month. Just be happy that you are out of the marriage if that's what you wanted.

Unf you only have three options

1 get her married.. which you say won't happen
2 take her back to court - the chances of this working are somewhere between slim and none
3 kill her.. really wouldn't recommend this one

so it seems that you're stuck

Wow tough spot to be in, the only thing I would know is to seek legal counsel, or if there is some way to convince her that she doesn't need/want your money any longer. I know that one is a long shot, but I honestly can't think of anything else.

Spend all your assets
and when there's none you know.....you can't make miracles just tell them IT's all GONE
