The plumbing in my apartment (and my other neighbors on the first floor) keeps backing up. It's disgusting, unsanitary, annoying, and unacceptable. Today is the 2nd time it's happened this week, and the 3rd time in the 5 months I've lived there. Is this good reason for me to terminate my lease? In this case would I be fined for the termination, or not?

You have cause to terminate. Take pictures and keep records.

In most states there is a website where you can go to find out landlord and renters responsibilities. The landlord usually has to fix emergency problems (heating, water, stove) within 24 hrs. and non emergency items within 2 weeks (these times differ in every state). If the landlord does not fix these things you can take them to court for diminished rental value, fix it yourself and take it off the rent ( Check your states requirements!!!). But in most states if these are not fix within the allowable time the lease is terminated by the landlord (for not fixing the problem) and you can move. In some cases the landlord would have to pay your rent (if you have to move because of a hazard condition) in a new place until your place is livable again. It is really worth your time to look this up. You probably have more options than you think.

You should notify your landlord & then the proper authorities if nothing is done about it. Have the state take a look at it & let them see whether its liveable & sanitary or not. It may be that, depending on where you live (city or amount of people living in the area) may have bad plumbing. It happenes in overpopulated areas that share the same sewage lines.

Listen to the chick that commeneted about the pics & video footage.If need be (&I hope it doesnt get to that point) it will hold up in court. But DONT listen to Jason. He's what we military people call a "Barracks Lawyer".

Not if the landlord is able to fix the problem. Three times in 5 months is not that big of a deal. Now you just need to make sure they do some serious work on the plumbing. Of course they will take the cheap route first and only do serious plumbing work if they really have to. Now they just really have to.

I think that you should buy a camera and document the times that this is happened. Then tell you landlord that you can not live under these conditions, and if it does not change than call the municipality of your town and tell them what is going on. Then tell you landlord that you will be terminating your lease.

Three times in 5 month is NOT valid grounds to terminate the lease without penalty.

yes you can terminate cause action "health concerns/unsanitary conditions reoccurring"...any fine should not be applicable in this cause but you need to read your lease... if i were you i would call health dept and have them take a look-see and if they find health concerns then your right as rain

i think of there's a protection rigidity clause that landlords could desire to honor to permit you out of a lease. communicate on your recruiter or a protection rigidity representative (or have your considerable different refer to somebody in family individuals help) and get some advice on a thank you to proceed.

**** the lease!! Don't pay the last months rent, move out and if he or she takes you to court you can settle it then. Leases don't mean ****.

I would first try hiring your own plumber and taking the cost off your rent.
