My husband is into drugs very heavily for almost a year now. I want a divorce, but since I do not work (I am looking and have resumes out now), and haven't, I am afraid that some idiot judge is going to give him custody of our children.
We had a high income before he lost his job, but they would not qualify it as drug-related, even though it was common knowledge that he was using.
Other than family and some friends and a few bank statements, I have NOTHING to document his drug use. Nor do I know how to even go about this and what I would need.

This is what you do. You file for divorce and take him to the judge. As a mother it is your obligation to get them to a safe, clean, environment and you are showing concern by getting them out of the situation even while you are without a job. The judge will understand this. Not that your husband is a terrible person, he may just need some help, but he will definately not get custody. You're the mother; it's not about money and jobs. It's who's showing that the children need to have a better situation.

Call your local police department tell them what is happening. You are afraid for you and your children because of the drug use. You do not want him to know you told on him. They can sit up and undercover camera, and recorder to get him doing drugs. When they get the information they will arrest him and you will have the proof for the judge so you do not loose your children.

If you can somehow get solid proof of the drug use, that would solidify custody for you...unless you have some dirty laudry that may come out.
