Will i get Divorce?

I am fighting my divorce case.I filed the petition in the lower court in jan2004.My wife refused to appear inspite of the various notices by the honourable court and also the marriage counsellor.In my 9 years of marriage we have stayed together for 4 years.
she failed to do fulfil her conjugal rights and that was the ground of seeking divorce. Lower court gave a moral judgement as this was normal wear and tear as she was stayin under the same roof.Now she has gone back to her parrents in April 2006 not returned back and i have filed petition in High court challenging the family court.Will i get Divorce

After all this time and mess, I believe the higher court will overturn the family court decision. Good luck.
