So my husband and I had our license plates revoked due to a mistake with insurance. We where told that we needed to contact the NC DMV to get a court date. They will send us a letter telling us when our court date is. Our friend, also in the same situation, just got her letter, and they where given 2 weeks notice. This has me nervous, because we have plans to go out of state(back to our home state) for two weeks over the easter holidays.

So, if they set our court date for while we're out of state, could we reschedule it?

I dont understand why you would have to schedule the court date through the DMV instead of the courts. I just went through mine this morning over a traffic and plate issue and i had to go through the courts, who gave me papers to give to the DMV.

I had a 12 hour notice because i went to the clerk of courts myself to inquire about the court date (they are the only ones who run their schedule)

What you can do is call the clerk of courts in the city that the problem initiated in. if you give them your social or your husbands social (who ever the plates are registered to) they should be able to give you all of the information you need.

Call the Court Clerk and/or DMV today and see if they will give you a court date that doesn't conflict. If they send you a notice and you don't show they may issue a capias (an order to the police to pick you up and take you to jail until you make bond). Get the name and extension of the person you talk to at the Court so that if things still get mixed up you will have a live person to whom to point. If they won't give you a date send a letter by certified mail return receipt requested to both the DMV and Court Clerk telling them you will be out of town (and when) so they don't send you a notice till you get back.
