The top two answers are completely wrong, at least in the UK they are.

After divorce, a woman simply reverts to her maiden name if she so wishes. A family lawyer once told me that just producing her decree absolute should be enough, and I was once able to get my bank to change my account name details back, since I had banked there before my marriage. The lady told me I would have to produce a Deed of Name Change and although I very forcefully stated that I had no obligation to do any such thing, and was able to bulldoze the bank into doing as they were told, even so, it is best to get the Name Change Deed drawn up and certified by a lawyer, since it will make life so much easier when dealing with the DVLA, banks, and the Passport Agency. The Passport Agency will need to see the decree absolute too and they won't budge for being yelled at, even by me! : )

It shouldn't cost more than about £50 to get the Name Change Deed done and it is available cheaper in some places. I think you might even be able to do it online.

You don't have to go to court for this. You really aren't legally obligated to change your name when you get married. A woman should still have her birth certificate and social security card with her maiden name on them. All she has to do is go to the DMV and fill out name change paperwork to change her driver's license, which is what she would have had to to do to change her name when she got married. Everything else, such as bank information and utility bills and whatnot is just a matter of filling out name change information, which can usually be done through the mail or online. It's really not that big a deal.

Notice how all the men who answered insist (incorrectly) that a judge has to issue some sort of decree as part of the divorce proceedings for a woman to change her name back to the name that she was born with?

When I was divorced in 1999 I just went back to using my maiden name without worrying about it. I didn't get it changed at court or formally at all.

This has to be included in the petition before the divorce is final to have the woman's name to be changed back to the maiden name. If the divorce is final, she will have to see an attorney and petition the court for a name change.

The lady in question has a legal right to start using her maiden name again. She can change it by deed poll to make it easier for the banks, etc, as some can be difficult about it, but I managed to replace driving licence, passport, bank account etc, without going that step!

I divorced my first husband 10 years ago and imediately reverted to my maiden name, I just changed everything back to it, Bank acc, payrol , bills ect.. I didn't ever change it legally and remarried 5 years ago using my maiden name and my decree absolute, with no problems. You were given the name at birth just coz you don't use it when you are married doesn't mean it stops being yours, its on you birth cert.

You don't have to take your husbands name when you get married - it's seen to be the done thing. When you get maried your still known as you with maiden name and you have to go around to change this with everyone you know and deal with. So just do that again. You will be still be traced by your original name anyway so doesn't matter how many time you choose to change it!

after my divorce I went to the bank and just changed my name back (as had banked with them before i got married) and also just reverted back to my maiden name , I dont think legally you have to do anything to change it back as its your original given name and even when you are married you dont have to take on the name of ya partner. Ten years later and I have re-married and have never had any problems.

Was part of my divorce. then you just have to change things like you did when you got married back to your maiden name.

i phoned everyone gas company, electric, doctors, dentist etc and had every thing changed over to my maiden name i sign every thing in my maiden name i have all my bank accounts in my maiden name and any forms that come that are important it will ask if you have been known by any other name you just tick yes and put your married name in the space provided and then sign with your maiden name
