No need to register a band name. I mean you could send yourself a SASE and not open the letter. So if it ever goes to court, you could give the judge the dated postmark letter with the name of your band inside. Nevertheless, not necessary. If there are two bands with the same name, why don't both bands have a battle of the band concert. I'm sure the local media would like the idea of two bands with the same name dueling it out in front of fans. Catchy public relations ploy.

It costs nothing to register unless you want enhanced membership. It won't necesarily protect you from getting ripped off by another band using your name, but at least you'll be able to check if your name is already in use. It also lets you know if the band is still gigging or has disbanded which can help if you want to nick a name from a disbanded band!

I'd just suggest you go onto iTunes and type in the name in the search field! Obviously iTunes won't have every registered band but it may give you some indication!
