since there is no court order, you could move them. however, the court might feel as though you are hiding the kids from thier dad.

No you can't just up and go. My sister's husband left her as soon as they moved here to pa and i took her to the lawyer's office and he said no you can't move back unless he consents. Basically you are screwed, consult a lawyer and good luck it takes 2 years from the time he left for the divorce.

I don't think its a problem until the actual divorce papers get started. Then the issue of visitation will require you to stay within 100 miles. I think you should set up residency back with your family and file for divorce there if you can beat him to the punch.

That's questionable, usually you need to get an OK from a judge to say you can move out of the usually 150 mile radius from where you file for divorce. talk to lawyer is your best bet

You'ld better ask a lawyer. My brother-in-laws ex wife moved their son out of FL without his permission and now if they find her she has to answer to kidnapping charges. All she had to do was get written consent from my bro-in-law. Find out what the laws are in your state.
