Honestly, I wasn't looking to fall for someone on the other side of the earth. Now, I have fallen hopelessly in love. She's a Philippine national who is a resident alien of Hong Kong and a contractually employed domestic worker. We could easily be together but for one small detail: She's married. Although she has not been together with her huband in the over seven years that she has lived in Hong Kong, the draconian laws in the Philippines will not allow her and those like her who have made similiar mistakes or suffered abuse move on with their lives. My basic question is: Can she get a divorce in Hong Kong that will be legally recognized for purposes of immigration to the US? With the over 200,000 Filipinas currently residing in Hong Kong, surely more than a handfull must have taken this route before, yet there is scant information on this topic. Any information that anyone out there can supply would be greatly appreciated. Thank you one and all for reading. Good luck to you all.

Strictly speaking, because she's a Philippine national, she cannot legally get divorced anywhere in the world. Philippine law will consider her still married to her husband even if she does. But I have seen it happen to many Filipinos and Filipinas before. She can get a divorce in Hong Kong, if that is recognized in the United States. If she marries you, and eventually becomes an American citizen, she can divorce her Filipino husband while she is in the United States. Get married again, just to make sure that your United States marriage is legal.

That does not mean, however, that the second divorce will be legally recognized in the Philippines. She will still be married to him regardless of how many times she divorces the Filipino husband. The thing is that she might not want to return to the Philippines because she could get arrested for bigamy. If she has children, that would hurt. A lot.

She cannot get a divorce in HK. She should go back to Philippines, find a lawyer and file for anullment. Good luck!

no the dissolution of marriage must be in the country it was performed in.
