I think it is sad when a man can be charged with rape when he is sleeping with his wife , I know he should have enought respect to not push it if she don't feel good or ?? but not called rape maybe a charge of assault ?? what about when a woman is drinking how the hell can you say she was taken advantagge of??? or when they have had a little lovers spat and the man takes her panty's off she says no he continues she don't fight not slap him but she charges him with rape,? men have stood by and let this happen and the ones who say these laws are good has eaten to much soy, meaning he is a female himself, just be honest and forget this P,C, junk

Agreed! I have always thought it was wrong to equate date or stranger rape and spousal rape as being one and the same. This is pure and simple socialism where we become property of the government. Of course, if a husband does "rape" his wife each case should be looked at and he shouldn't go unpunished. But to put this rape along side the others I've mentioned is ridiculous.

This also goes for charging a parent with kidnapping their own children. Again, if a divorced parent takes off with their child each situation should be looked at and possibly that parent should be given jail time, etc. Placing it on the same level as stranger kidnapping, etc. is horribly wrong!

In each instance they should not go unpunished but it should never be considered the same crime.

I was alive before the laws were enacted charging spouses with "rape" and parents with" kidnapping". They didn't get off scot free and would be sentenced with jail time, but they also were not labeled, "rapists and kidnappers" for the rest of their lives.
That's when the world was a much better place, in every aspect!

It was Jerry Lee Lewis and he was charged with having sex with a minor. He married his third cousin at 14, the newspapers reported her age 13 and he was banned that year from performing in England. I don't know where you heard this rape charge and five men thing. They were married for a number of years. Hillbilly's tend to marry young...
Never read of him being charged with rape. I used to go to his concerts and see him perform......

I understand what you mean. The laws are fair. They protect those you have been raped. maybe the laws need to be more specific. and I'm sure the court doesn't just say your guilty they have to do some investigating.

but this is why you have a point:

i have this friend. He like this girl. The girl was breaking up with her boyfriend. She had sex with my friend. The girls ex boyfriend found out and so she said she was rapped. MY FRIEND luckily was on probation for like 1 1/2 years... Please tell me how that is fair?

I'm sure the person asking the question doesn't mean any harm and I'm sure the person is also not saying to get rid of rape laws, and that women(people) should be allowed to be raped...

The person is making a point.

some women use rape as a weapon... and that is what needs to change.

I also believe the punishment enough. Castration and jail - sounds enough to me... i think its better punishment then death. Death is too easy your actually letting them getting away w/ the crime rather then punishing... You die, no suffering...

Again, are you serious?! So you're saying that her saying "NO" isn't enough to express the fact that she's actually saying "No?" You're saying she needs to fight him so he understands that she's saying "no"? Well theres the answer to your inquiry. Rape laws are totally fine because obviously men need a bigger wake up call to realize that NO means NO!

And you don't think that if rape laws turned into smaller, "assault" charges, that vicious offenders out there would claim more victims???

Think about the scenarios before you judge whether or not something is unfair. And you need not worry about it unless you're in the position to be charged with rape. And if you ARE-- I don't think I need to say anymore.

No means no weather you've just had a little spat and she's been drinking or not, when some one say no it means just that. How would you feel if say you got caught driving drunk and get arrested and put in jail, while in jail some guy wants to use you like a woman. If you said NO should you have to fight him off, and what if it doesn't work then what??? If you tell that person no does it mean no or should they just continue to do what ever they want just because they can? Right now your saying that would never happen to you because you'd hit them. Well believe me it can and it does happen all the time and it is called rape not matter who it is getting raped.

Would you want some thing taken from you just because that person is maybe bigger or stronger than you and they didn't care weather you said no to them or not?

Just because you marry some one that doesn't give you a right to take it when ever you want. Even a wife has a right to say no and to mean it, it is after all her body and not her husbands. Getting married doesn't mean that you bought your wife or that you own her. She is still in charge of her own body and she can say if she wants to go there or not. And weather you like it or not the woman has a right to press charges, because it is in fact rape if you take what has not been given to you to take. Just being married to her doesn't mean that you can do what you want, if you take it yes she can press charges against you. The law will be on her side, after all once again it's her body not yours.

There is no way that you can ever justify rape or say that a man has a right to take some thing from a woman. Once the word no has been said that's all you need to know and hear. That one word says it all (NO) it isn't a green light for you to strip off her clothes and do what you want.

Even in jail/prison inmates can be raped, it is still against the law even in there. So if you go to jail, would you want that law gone from the books that also protects you as well or would you want to press charges against some one if they raped you.

Oh wait I guess you'd just want to be raped!! Or are you going to be a real man who steps up to the plate and eats soy with the rest of the real men who agree that it's wrong. Agreeing that its wrong doesn't make you a woman but it may just keep you from being raped. And if it doesn't keep you from being raped at least you will be able to press charges and have some satisfaction seeing the person get punished for what he did to you.

It's time to grow up and realize that women have a say over what happens to their own bodies, just as a man does. No one ever has a right to take what do not belong to them, ever!!

A woman can consent to having sex, then for whatever reason change her mind during the act and call it rape. Or be pissed off just afterward and claim rape.

What pisses me off is that people act like men can't be raped. An example of male rape occurred in the film 40 Days and 40 Nights. Josh Hartnett's character is trying to save himself for this one girl. This other girl takes advantage of this and has sex with him pretending to be that other girl. That's rape. If that had happened the other way around, where a guy pretended to be another guy so that he could have sex with a girl, then everyone would have been crying "Rape". But with him what happens is that the girl he was saving himself for leaves him when she finds out, like it was his fault. What crap.

Different states have different laws regarding assaults and battery of sexual nature. Judges and juries examine evidence and determine the guilt of the defendant...I think your disagreement is with your peers who provide the convictions and who have much more empathy for the victims than you do. As an ex police officer and a firefighter, I have seen the victims of these crimes and the personal devastation that it brings. I think you might change your mind if you were raped or sexually assaulted yourself..personally I think the punishments of sexual assaults and related crimes are too lenient...the criminals need to be separated from society until they are no longer a threat...and that may be a life sentence.

alot of people are raped by someone they know, so being the husband/boyfriend is irrelevant when it comes to rape...forcing sex upon someone that doesn't want to IS rape. trust me, if you were a rape victim then your views of the law would drastically change. you have no idea about the life long effects of being raped! yeah, i think its absolutely pathetic and stupid when some women claim rape when they get mad or jealous when it actually never happened, and i think those women deserve jail time because if they only knew what it was like then they would NEVER lie about something like that. but as for the laws i dont think they are harsh enough. rapists deserve life in prison, they put their victims through hell for life so they deserve the same. when a woman is drinking??!?!?!?!?! WTF do you mean "how the hell can you say she was taken advantage of?" what do you think being taken advantage of means??!! there's no excuse to rape someone...none. no one asks to be raped, only stupid good-for-nothing s.o.b's rape someone and say it was okay because she was drunk!

I do not know which is correct. I know a friend whose wife practiced submission (a kind of sexual act where the wife is bound by leather straps and had sex as fun) and taken video clips, photographs, etc. Now, she is threatening him to use this as evidence and going to push a case of rape, etc. My friend is disillusioned and do not know what to do. I think Rape law should be in such a way that the female do not use it as a weapon.

The worst part is that the next day after having consentual sex with a woman she could call the police and have you arrested for rape. Therefore a woman can decide after the fact that she shouldn't of had sex with you for whatever reason and that makes it a crime. Whereas a man can not do that.....

Just because the woman is your wife does not mean she is your personal sex toy. She says NO, you do it anyway, that is rape. If you're that horny, go masturbate.
You get a woman drunk and take advantage of her, that's rape. Using your twisted logic, I can get you drunk and take your wallet and it would not be stealing.
As far as your lover's spat goes, same thing; the woman said NO. Sex after that is rape.
If you haven't figured out that sex between a man and a woman is a gift of love and respect than you are not a man; you're a punk.
