I have been seperated for 1yr and ex wife still wont let me have anymore time than 7 hours, one day a week. I'm australian my ex is from Hong Kong. She want's to take them to China for a holiday but am afraid she will not come back. I have refused them to go, I live 10 minutes away from the kids and she wont let me have them overnight. I love my kids and they love there daddy. What can I do to convince her, do I take her to court? It is so expensive $10,000 - 40,000 to get her to change her mind through the law.. Please any suggestions would be greatly appreciated..Thank you.....

I cannot understand how she could possibly not understand that as their father you have the right to have 50% custody of your children. Something is very wrong with a society that will allow any court to give one parent more custody over another. It takes two parents to make a child, and that child has a right to both its parents equally. I would suggest that you sit her down and explain your wishes to her, as well as how this is in the best interest of your children as well. She has to realize that she may not want you in her life, but your children need you in theirs. If she won't allow you your children 50 percent of the time, then you have every right to take her to court, and should do so. I know it's expensive, but it must be done if she will not allow you to have your children. I hate threats, but in this case a good solid threat might be necessary to get her to see things clearly. Your children will adjust to the divorce as long as you and your wife handle things maturely and are willing to share them equally. Good luck, I've always said men do often get the short end of the stick when it comes to family law.

Your divorce was probably caused by a control issue.Right? Next time tell her that you will keep them overnight if she doesn't answer her phone or she isn't there when you are suppose to drop them off. If you have to you will drag her back in court and tell the judge she isn't meeting her obligations and that when you take them home you expect for her to fulfill her obligation and be there other wise there has to be consequences . Also tell the judge she wants you to leave the kids with the neighbors and that is a issue of there safety. I hope this helps. Also your doing a good job keeping records . keep up the good work you might need them , try and be as accurate as you possibly can.

You can try talking to her calmly and explaining that you think it's important to put the needs of the children first. You can invite her to attend counseling with you to see if there is an intermediary who can help you (try Relationships Australia) and if that fails, you can seek mediation through the court system before incurring large lawyers bills. There are good websites with advice around, so have a look to see what they say.

Take it to court as soon as you can before she takes off with the kids and make sure you get a court order that she cannot take the kids or your screwed

TOTALLY TAKE HER TO COURT!!! Unless there is a reason for the limited visitation (her being a psycho ***** is not a good reason), then there is nothing for her to stand on to justify such limited time. Get a court order to keep her in country. DO NOT LET HER LEAVE!!!!!!!!!!!!!!!

sounds like your ex-wife is using your kids to get back at you, keep calm, and if your uneasy about her taking the kids, then go through the proper legal courts
