Recently I was rear-ended by some idiot who was not paying attention, my car was totaled! Also my wife sustained a broken nose, big black eye, and many bruises. I sustained a swollen hand, lacerated eye, neck strain, and bruises. Can I sue for those injuries? are they serious enough? Rigtht after the accident I refused care because I was in no pain, but when I was at the hospital with my wife, I began to feel a lot of pain. I guess the adrenalin wore off. The next day I had to return to the ER due to extreme pain in my neck (from the whiplash of getting rear-ended) I was put on pain meds, muscle relaxers, and anti-inflamatory meds. Oh and my wife is 2months pregnant. Please help Yahoo! guys and girls

Sorry I forgot to add. My MEDICAL insurance paid for all our medical costs, does that mean that the other drivers car insurance company gets away without paying anything. At the hospital I gave all my medical insurance info, recently I got a letter from the hospital saying that all cost were already paid by my MEDICAL insurance company. Is the other drivers CAR insurance company gonna get away without paying anything? They have accepted FULL fault, since I was rear-ened.

Absolutely, You don't have to be rushed to an emergency room. The injuries were not your fault and you should not have to pay. Contact a personal injury attorney, they can represent your interests with the insurance company. I would give the insurance company as little info as possible until you talk to the attorney, and do not sign anything. I

I'm not an attorney, but perhaps you might submit any medical bills or records as they relate to the accident to be submittet to the other drivers insurance company. Your own insurance company should also be very willing to answer questions you have as they relate to this. After calling your insurance company, you may have a better idea on whether or not to get an attorney so you can be reimbursed for your medical expenses.
OOPS, I see the answer above me said not to sign papers. Yes, do not sign anything!!! YOUR insurance company is on your side and a phone call to them should get you started in the right direction. You want to get it rolling, because it can't be done after so much time. I'm not sure how long.

yes, in most states you are entitled to what is called 3 in a half times the specials for pain and suffering, metal anguish, lose of wages, and where i am a paralegal you are intitled to loose of affection if you are married. (no sex because you are to sore or you just cant look at her with a black eye much less have sex with her) ARKANSAS. The "specials" are all medical bills and lose of wages added. general the amount paid is 3.5 of that figure. the insuance companies will begin offering you 1.5 to settle out of court. hold there feet to the fire and get 3 times

Well certainly you can sue, but you may want to check with a personal injury lawyer to see what he thinks believe me if they think you have a good case they will take it-and if they dont get you anything than they dont get anything-so if they dont think its worth it to sue they wont take the case-also did the persons ins pay for your injuries because if you paid you should be able to get reinbursed-providing they had ins, good luck

Of course you can sue. Get a lawyer now, and don't sign any kind of insurance papers until you do get one
