Me and a friend were accused of using drugs in the bathroom at work. The GM said someone "saw us" using drugs.So he told us were were suspended until further investigation..all he has is hear say...We told the GM that we would take a drug test to prove it.and he said that, that was not his policy. So i told him that legal steps would be taken. As soon as i told him that he said he would let us take a drug test and if we passed we could come back to work. So, while on our way to take the drug test at the hospital we get a phone call sayin that it was announced at work today that She and I were fired for snorting cocaine in the bathroom. SLANDER???and he told us we were just suspended not fired..so then we call and ask him what that was all about and he appologized and said that it was miscommunication and that he was very sorry..so the day went on and we got 3 other calls sayin that managers were tellin everybody about it...

First, go talk to your Union Representative. If you have no Union the talk to the Personnel Manager. Carefully explain what is going on. Sounds like your manager is way out of line. If the Personnel Manager can not straighten this out, time to talk to a lawyer.

If you live in an At Will state, it will not matter. The employer can fire you for any reason, even if it is bogus charges and accusations. What you can do is create a huge stink, but that will not help you find a new job.

Get your stuff together starting with the drug test. Then find a lawyer to handle your case. Ask the lawyer to get statements from the people who called you, your supervisor and the GM.

I would contact a lawyer in order to sue the company. I hope you followed up with those tests. If you were cleared, they don't have a chance, but you will need a lawyer.
Were you both in the bathroom? Maybe thats grounds for firing you both.

My opinion, is that you chould get the story straight before you make any descisions. See if they offer you your job back. If they do this could be a high point in their favor in court. Be sure to have witnesses that will testify in your favor. If they dont give you yoru job it sounds like an easy win in court. Good luck
