Yep, 38 states still have capital punishment on the books. Texas is the top killer, with 383 killed since 1976 (when the death penalty was reinstated in the US).

Very active in Texas and Florida. I think California still does it too, but not sure. Many states have either stopped it or put it on hold.

Yea, it does exist; its just some states use it, but others dont.
