If you read my earlier question, it was about me getting 2 detentions for something that wasn't my fault. Well I have researched it and in the 14th Amendment it states the "Due Process" in which you HAVE to give a student to state his/her side of the story, which she did not give me. I have just e-mailed my math teacher about it. Do you think this will work? Thanks!

Excuse me, everybody, but the Due Process also has to do with the school system. Look at the case from 1969. It was Tinker vs. Des Moines.

The 14th Amendment has to do witht he due process of the law under the court system of the United States of America. Not the rules and regulations of a school. The 14th Amendment does not help you with detentions because you haven't been arrested and imprisoned.
You have the right to email your teacher and ask to meet with her in person to discuss the issue, possibly with the principal as well. But you will have to read your school's policy handbook to see what your students' rights are. And maybe you can ask your parents to meet with you and your teacher together as well if your parents believe your side of the story and are willing to back you up. If not, take the punishment and deal with it. Hopefully it won't happen again. If this teacher has a habit of giving detentions often, maybe she has issues that the principal has to deal with.

Your school is probably not a government run organization therefore, it probaly does not abide by the rules of the US constitution. Usually in schools the teachers are in charge and the students are expected to follow directions, you don't have much freedom to be yourself in school. Just be glad that you don't have to wear a school uniform, or do you?

It is just 2 detentions, you probably deserved them. Just suck it up and go to them, what are they like a half hour long??!!! Thats nothing just chill out for a few minutes after school then you can go home for the day.

I hate to break it to you, but many schools have this stupid philosophy that once you go through the door, you have no rights. That's what every teacher in my school says, if we stick up for something that isn't right, or try to defend ourselves, we just get sent out.
