my husband and i are not divorced or legally separated yet, but hopefully will be as soon as possible(we are not living together anymore)! I have an appt. with an attorney on March 7th. Anyway, I want MY last name back, and I was just wondering when I can do that, what office in the courthouse takes care of that stuff, how much it will cost, and how long it will take before my name can be changed? Thanks! :)

You can legally change your name at any time. But to save time/money, tell your attorney to include that in your divorce petition/decree. That's what I did, so as soon as the judge granted the divorce, I had my name back. Of course, you have to go thru the changing of your social security card (first thing), driver's license, bills, credit cards, professional licenses, etc. My one tip for this.....make several copies of the page of your divorce that states your name is returned. Mine happened to be the page of the divorce that got stamped. I highlighted that section, and sent those in with everything I wanted to have changed. I still carry a copy in case anything comes up that I didn't think to change.

You should be able to change your name any time you want to. There is no legal requirement that a woman take her husband's name at any time. Ask you attorney---it's a simple process in most states.

I got my name back the day the divorce went through...but that was in Michigan 16 years ago...things may have changed since then

at the signing of the divorce you have to petition that you want to use your maiden name
