Do I need to an attorney wheen I bring a modification of child support agains the children's father?

I have brought about a motion for modification of support with the DA. (I live in Calif) My ex (who owes more than $10,000 in arrearages) showed up with an attorney and no paperwork. We go back for the hearing next month. I was under the impression the DA was representing me. DO I need an attorney. My ex will argue he owes less, etc...

You should bring an attorney, that way you will know that your best interest are looked after.

well, your ex can argue til he's blue in the face, they are going to tell him he has to take that up (any dispute in arrears/payments) with the child support department.

they want to address the amount, and NO, you dont need an attorney. its pretty cut and dry, they want the money or a chunk of of it.

but i will tell you this, if your caseworker (or dept) isnt on the ball, you need to pull rank. its should have never been allowed to get to that amount.

next time, put some heat on the case. sit down and write a letter. in it give you contact info, case number, his info, and the problem. ask what they are doing about it.

then take that ONE letter and FAX it to the following:
1) your state Attorney General
2) your state Governor
3) your Regional FEDERAL Child Support Office

all links are below. you see, phone calls are useless; they are ignored, denied and forgotten. mail ends up in someones "to do" pile, but FAXES... are effective.

if you ever cant find a fax number (most are listed online) then just call and ask for it. fax it weekly if need be, but just keep on 'em. the squeaky wheel gets the oil...

the child support officer is for your children............she is the one that goes to court it would NOT hurt for you to have a lawyer as well....see if there is a pro bono one in your area, plus in Ca......there is often a free person that is actually in court at least in the santa marie courts there was.

Also hun, he can argue WHAT he likes, the arrears are what the Child support office says it is NOT what he thinks it should be
