You are right. Only if you misrepresented it as original, would that amount to actionable fraud. If someone is willing to pay for a copy, ( I can't imagine why someone would, though) you have no problem. I'm surprised everyone else thinks something is wrong with this. I used to be a lawyer. Were they?

Forgery is when you sign something and attempt to pass it off as someone else's signature. But using a photcopy and telling someone it's a copy is completely the opposite of forgery. Think of it this way: Most "paintings" are copies. You can buy a copy of the Mona Lisa, even, and as long as you aren't paying millions of dollars thinking it's the original daVinci, it's legal. right?

Note: There's an artist who pays some of his bills by selling a PAINTING of some currency, like a hundred dollar bill. He therefore is "selling" it as art. He is not counterfeiting money. What he does has held up in court. As long as he is honest, not passing something off as other than what it is, it's OK.

But I would suggest you put that in writing, and get whoever buys it to sign a statement that he understands that the autograph is only a photocopy. Don't just "mention" this by mouth. It's important to cover yourself later. If you think I'm wrong, try calling your local police department. They often answer questions like this, at least if it's a criminal matter. They won't answer matters of civil law.

Yes, it is illegal if you don't tell them it is a copy.

Copying someones signature is called forgery.

Selling a forged signature is called fraud.

You would actually commit two separate crimes if you do this, and they are serious crimes that can get you serious time.
