Universities and mascots: Do universities infringe upon one another when they share the same mascot? Why not?

Do you infringe on someone when you are both named John? There are just so many mascot names to go round. Would you like to see a team called The Lemon Drops? Not me.

I don't think so. Mascots are not trademarked so any school can use whatever they choose. There are thousands of universities out there. It would be impossible for them all to have unique mascots.
