hello, i am currently in the middle of a child support case, i have to go back on march 1st for a permanent child support order. i filed on the father of my children. to make a long story short, i put in a request for a states attorney through child and was told to check back to make sure i will have one present. i checked today and was told no one has responded to my request. my question is, is there some type of way i could find an attorney on my own without all the fees??? i was also told on my first child support court date that i could not handle my kid's tuition in that court room. i was told this when i tried to present receipts, i thought that was kind of odd. any help or advice would be appreciated!!! i live in chicago in the southwest suburbs. my court date is downtown.

i would also like to add that the father of my children called me a b**** in court and nothing was done about this when i told the judge, after i told the judge there was an exchange of words and we were told we would get arrested. all i did was state what he said to me which i am sure the judge heard him say this anway. what can i do about the lack of concern for his actions??

to the gentleman below, the judge DID hear what my ex said to me, if anyone had to go to 32 w. randolph for a child support case, you would know how close we were to the judge, you are literally and directly sitting in front of the judge. thanks for the advice though, i appreciate it.

First you have to understand that each state has its own child support scale set for each child involved. Bringing in receipts does not justify or determine the amount you get. The judge awards you custody and support and then the judge sets the amount per child per each month til a certain future date. You can probably handle your own case now as it is a final judgement hearing so an attorney is not necessary, you can answer for yourself and save the money. As for the other part if every Judge reacted to every outbreak or outburst in his court,the jails would really be full. This happens probably every hour somewhere. To act upon this now comes down to its your word against his and you cant say what he heard or didnt hear. So let the latter go and worry about what is important at hand. Take what the judge awards you and learn to budget because thats all youre going to get for now. Good luck

You need an attorney! I would also check your local listings for legal non profit support. They usually don't charge and will get you started with the right paperwork. Also, Google child support Chicago and you should get lots of answers. Just remember don't make this a revenge case. Keep it civil even if your ex is an a**hole. Children don't need to be witness to the crap adults put themselves through. Good Luck!

Depends on where you are at. It sounds like you are a woman, and there are numerous resources, private womens organizatoins and such, that you can call for referance. If you checked with your local YMCA counselor, they would probably have a list of all the organizations in the area, or know someone who does.

if i am understanding you right, you have the right to a free attorney and they have not assigned you one yet.

FIRST, you need one. as for a letter from them stating that non responded from your request. you may need it at court to ask the judge for a new court date. if he wont give you a new date ask him why. also ask him how to get a copy of the transcript or tape of the hearing. your are entitled to a copy of every single hearing you have (for a fee) before any judge.

IF HE CALLS YOU THAT IN COURT AGAIN;
say exactly this "he just verbally assaulted me in a court of law, and i want a copy of that transcript or tape. how do i get a copy of that tape?"

also, if the judge did nothing about it, you have the right to report him. i dont care if he hears it all the time (so hes numb to it), he did nothing about it in a court of law. I would file a formal complaint (i'll find the link for you and post it).

and i dont care how pissed off your ex is (they all are and some even say that shyt to their kids about their mama), he should be held accountable or it just condones and encourages MORE behavior like it.

CHILD SUPPORT
if your caseworker (or dept) isnt on the ball, pull rank on em. sit down and write a letter to your states Attorney General, Governor and Regional FEDERAL Child Support Office.

when my husband tried to get a public defender they said they didn't do custody battles anymore.... not to worry a lawyer you pay out the butt for is always better than a public defender.. a public defender doesn't care because they get paid either way
