Legally whenever someone takes a picture or video it is automatically copy written to that person.
So if you didn't take the video, then it's copy written to someone else.

Obviously if you didn't make it, someone else did. So why would anyone think of taking a video if they didn't know if it was copy written. That would be plain stupid.
