has screwed my stepdad over. In July his ex wife filed papers saying he made more then he really did. My dad contested it and they stopped all payments until further notice well in Oct. he recieved a judgment in favor of the ex. He has paid the amount since oct. Now that he and my mother have filed taxes they can't recieve anything back because they said he did not pay from August to Oct., but we weren't notified of a judgement until Oct. We called Kansas state where all this took place and the county lawyer openly admitted that he failed to notify my stepdads employer of the amount change. Now they say he is behind in child support is this legal that they can take his taxes for their faults????

I'm with you that this sucks, but there really isn't anything that you can do. My brother and his ex went to court to decide on child support and the courts issued the amount of $485.00 per month for one child....but they also made him pay back support for two years, even though there was no support order in place at that time he still had to pay it. He hasn't gotten any state tax refund in about 5 years now because of it. He's not a dead beat or anything and always pays, but this is what the courts are like.
Now why can't the go after the real dead beats this way??

Sounds to me like the lawyer made the mistake, maybe he or she should be liable for the error.

Being divorced several (5 ) times, I have a pretty good handle on child support. One thing I know for sure, the person paying the support rarely wins any adjustment. In fact. the person receiving the support doesn't even have to hire a lawyer anymore. The district or state attorney general will file for back payment at no cost.

Be careful, or your step Dad may end up having his photo on a milk carton as a father that doesn't pay his child support
(Bad Dad's). My opinion: Divorce lawyers don't have the smarts to tackle the attorney generals office, good lawyers would cost more than owed.

My advice: Lick your wounds, tomorrow is another day.

first of all, any of that will be adjusted and applied to the case. nothing to freak out about. ITS RETRO.

its obviously an error on their part and it will be adjusted. and obviously he owed A HUGE amount in order for them to even take the tax refund (its $5,000 to put a tax refund intercept in place in most states).

mr stepdad should have paid it before it even reached that amount. you see, years ago, parents would hide until the the child turned 18, but today, arrears are forever.

second of all, what are you doing knowing all of your step fathers ex's court battles and personal business? do they discuss these adult issues of child support, court, arrears, etc around you? how is it possible you know all of these details?

Okay everyone else has given yo advice in a different way. Though most of what they said is true. You mother can file a Injured spouse form and the IRS will give her her portion o fthe tax return. They won't hold her liable for that.

Yeah, they can still take the money, because, regardless of the fact that they waited until Oct. to tell him, he still owes the money. Totally sucks I agree, but I don't think there is anything anyone can do about it. It never hurts to contact a lawyer for advice, though.

Yes because it is money owed to the children no matter who's fault it is. It is for the children. I know how your step dad feels, though, it happens to us every year my husband is behind. the first year we got together he was way behind and they took almost all of my tax return (for MY kids) to give to his kids because we filed together. At least they can be glad it is paid and it should not happen again if he keeps up on the payments.
