My neice is pregnant, she is 17, will be 18 next month and her boyfriend is 21. She's afraid if she tells her mom she's pregnant then she will throw the boyfriend in jail. Is it still rape if she's 17.

Legal age of consent in Illinois is 17. Illinois law makes 18 the minimum age at which teachers and their students
may legally have sex. Age 17 does not apply to teachers or any other school employee in a "position of authority" over the minor.

I don't think it would be considered rape. I am not a 100% sure, but I think anything 16 and under would be called a statutory rape...but as i said I am not a 100% sure.
She needs to tell her Mom sooner or later anyway and if she is turning 18 next month anyway...what's the big deal? I hope she and her boyfriend will be able to provide for the baby.

The only people here giving you the correct answer are those saying that the age of consent, barring teachers, in Illinois, is 17. Her boyfriend did not commit a crime (assuming that there was no sex when she was 16).

statutory rape (rape with consent)...yes...until she's 18, it would be a risk to the young man for her mother to find out. She can go for medical care at Planned Parenthood without her parents being notified. Once she turns 18 her mom won't likely cause any problems

I think it is technically still statutory rape, but i heard its extrememly hard to get a conviction if the girl is 17.

It should be illegal for any 17 year old to have a baby. Especially if you live in Illinois.....good luck!
