my 15 year old son has been known by my maiden name since he was 2 years old, eg medical, dental records and schools. My ex husband wont agree to him changing his name by deed poll so that he can get his passport, which he desperatly wants. I don't want heavy court costs, not sure what the way forward is

Your son's legal name is that which is on his birth certificate.

My kids took my second husbands name and when they turned 16 we had to have it legally changed so they could get their drivers licence.

Now, if he has gone by your name for all those years, just petition the court for the name change. You will have to post it in 3 major newspapers.

When we went to court we saw the judge in chambers and she asked the kids a few questions and when she was satisfied that this is what they wanted - it was granted.

I doubt you have much problem with his name either because of his age. He is old enough to know the name he wants to go by. Just show up with all the records that show the name he has used all his life.

Your X can try to fight it but I doubt he gets very far since in a few years the son can get it changed without permission form anyone.

I dont know if you have already called the passport office for advice. If i have read your question right..if he has went by your maiden name which is diff from his birth cert name you can still have it in your maiden name. I been called my surname since i was 3 but my birth cert name is diff. My passport is to what i am known by and not on birth certificate. Phone the Passpost office!

i'm confused. Do you mean that the name on his birth certificate is different to the one he is known by? Just get him a passport in the name on the birth certificate.

Well, i thought deed poll only required carers permission. Which is strange as i know a friend with a simular case.

You should have went by the fathers name all along if thats what is on the birth cert...With your concent he can change his name at any court house...But, if I were you just get the passport in his fathers name..it makes sense..cause is social is in his fathers name...
