Better consult a lawyer, if her name is on the deeds I have a nasty feeling she owns half of it. Perhaps the fact you weren't married will go in your favour.

I'm sure that the deeds to a house is a legal document naming those with a stake in the house and how much each has, that won't change over time, a landlord still owns a house even though they don't live there. It might be possible to offset her gain in value against her unpaid half of the mortgage. The law and common sense don't go hand in hand.

I dont think she is entitled to half, make sure you can prove that it is you that has paid the mortgage all along. She may have a vested interest, so if you sell she would get a percentage of the profits. I would get some advice maybe from the Citizens Advice Bureau before you pay for a lawyer.

I think things might be in your favour given the lenght of the separation and the fact that you have solely repay the mortgage but my best advice is to seek a legal advice.

Good luck.

Seek advice on this one, she maybe entitle to half the house until the day she left is you can prove that she has not been paying towards the mortgage.
Very tricky, seek legal advice.

If you are in the US you may be screwed.

Here's what I would contemplate. Get a fake power of attorney for her, sell the house, change your phone number and move. It's going to cost her a bit cash to come looking for you and her share if you are here and she's there. I'll bet she rolls over.

oooh. You should have had her name taken off hte deeds as soon as she left. i think you are on very dodgy ground as she could well be entitled to half. isuggest you get to a solicitor fast but i think you will need a lot of luck (and proably an expensive court case.)

Get an attorney or have her takin off the deed becasue she is not even here...
And if you are not married why would you do that in the first place?
