Because our society is still very prudish when it comes to nudity or even toplessness. Thankfully, in many states (like NY, where I live) that's changing, and it's now legal for a girl to be topless anyplace a guy can be.

It's a good example of allowing a given moral belief to become law. There is no good reason to have laws about what is essentially fashion or the lack thereof.
