I live in NY he's in VA anyone know which state I have to go through for the divorce.

I just moved back to Ny 4mths ago. We were married here and lived her for 25yrs of the marriage, the last 2 in VA. I think its 1 yr here in NY also.

That;s a simple question. Whoever files first, and has been domiciled in their state for the requisite period of time. You can file in your state and have him served by certified mail (where he signs for it), and that generally is sufficient for service. Contact your local courts, and they have an advice/document preparation service generally to help you.

See which state has the shorter waiting period for the divorce to be finalized. Then the person living in that state should file.

I live in Maryland and I now have to wait A YEAR until they will finalize a divorce. If I lived 20 minutes away in PA, it'd be done in 90 days!

Probably the state where you last lived together as husband and wife. But you probably want to check with an attorney. A lot of attorneys will answer this question for you by telephone with no charge in order to get your business. Good luck.

I would suggest trying the state in which u reside...contact an attorney as they are best qualified to offer this type of advise

I would think that if you live in New York and you are wanting to file for divorce, you would do it in the state you live in. You will have to have the paperwork served.

Depends on which one is filing for the divorce...file in that state.
