who would get the house? Here's the situation. In August my fiance' and I are getting married. We have been living together for 9 months. As of right now if something were to happen to him his house would go to his parents, then his brother and his wife, then their kids ( his nephew and niece ). I know that if something were to happen to him now there wouldn't be much I could do. My name isn't on the house or any of the bills, but I work and help pay the bills. Anyway my questions is... in the state of N.C. once we get married does everything he owns automatically become mine? If something were to happen to him do I get the house or does he have to go change his will in order for that to happen? I'm asking this because his parents don't like me very much and I feel that if something were to happen to him I know they would want me out! I have a son from a previous relationship and I am so afraid we would end up homeless even though we have made this house our home.

No I'm not marrying an old man but you never know when you are gonna die. Car accidents, cancer, etc.

I am not from NC...u need to find out if u are a community property state...if so yes,,,AFTER marriage u would get the house UNLESS he has a last will and testament that would state otherwise

U must be marrying a very old person to be so concerned with his death....life is short..simply enjoy it.

For North Carolina - he needs to change his will. If there is already a will out there that means that although you are his wife the property will go into probate while the family contests. And you wouldn't have the legal standing - they would.

You need to talk to him about this. If you divorced him then the property would have to be equally divided - but if he dies it goes to his heirs named in the will. Funny how that works. You need to talk to him about making sure everything is provided for in the event of death - through life insurance and wills. The same goes for you. Paper work like this needs to be worked out before marriage.
