One spouse is living here after deserting the partner in USA.

Any divorce decree is valid in India if it has be granted by the court of jurisdiction under the India Matrimonial Statue such as The Hindu Marriage Act, 1955 or The Special Marriage Act ,1954 or any such enactment according to which the marriage was solemnised between the parties & according to which the parties could claim the decree of divorce . If the divorce decree passed by the USA court under the Indian Statue as mentioned above, it will be valid in India also.

Any US court would of taken the measures to inform the other party even if they were not present or whereabouts not known, ie: publications etc. If one party is living in the usa, a resident or citizen then the divorce judgment is valid regardless of where the other person is residing.

It is valid in USA only and Indian courts are not bound by it.
