Stringed instruments are affected by temperature, humidity and many other factors. It's not realistic to expect your violin to be in tune whenever you take it out of the case; just be patient and learn how to tune it well and you'll be fine :)

I disagree with taking it back because my violin goes out of tune about every other day. I have an electric tuner, but still. Anyways, I asked at the music store I rent from and she said it happens to most everyone. She said its not something to return or get a refund since it is common. Temerature is a big issue especially if your violin is near an air vent.

it may need to be restrung, new strings will hold there tune longer, or it just may need to be adjusted- take it to your music shop and have them look it over...

Yes you should return it and ask them to repair it or get your money back.
