Any links to websites on this matter or any pointers in general would be helpful. There is a position within the company i am with at the moment that i would like to take, but it is not being offered internally and therefore I can't apply (this is not a question of crudentials or experience). Is my company legally obliged to offer this position in house before advertising externally?

They have no obligation to offer it to existing employees. They probably know the limitations of all of their present staff and believe there to be no one within that can carry out the duties of the new job. My advice is, as long as you are confident that you can do this job and do it well, is to see the head of the department that is looking for this new person and declare your interest. They can only say no and you will not lose face and you might bring your ambition into the frame for future promotion.

There is no legal requirement for the company to advertise internally. Thay can define the selection criteria with specific skill sets or the fact they want to bring a "fresh perspective" from the market place. The company however would be very foolish if the right level of skill set and experience was sitting in their own organisation. Why not ask HR why it is not open to internal candidates if you truly feel you have the right skill set.

My suspicion is they already have a candidate in mind from external and therefore are following a process in name only.

No Taffy Army --- No Legal Obligations Whatsoever --- It depends on the company,s Judgement and Requirements --" Best Person for the Job" --- Not always "In House" But often the "In House" Person is Usually familiar with the "Business" and it can be an Advantage ?? Depends on the Circumstances ???

There is no requirement to fill from within.
If you think you are suitable qualified, you should have a talk with the person responsible for hiring for that position. You should express your interest and ask, what you could do, so when a similar position opens up in the future you would be considered. If they didnot consider you, the manager might look at your qualifications and let you know where you should improve.

Nope there is no requirement whatsoever to offer it internally.
That does not mean that you cant apply for it though. It would just mean that if you were offered the job you would have to resign from your current position and then restart in the new position

Actually it's up to their own written policy so they cover their own butts. Doesn't seem fair, does it?
