My wife passed away, in my case who will get my wifes share? I have two over 18 year old kids. I am told my kids will get it. Is this correct?

I don't believe so, unless she has a will specifically leaving her grandchildren something. If she has only two living children (since your wife has already passed away), and no spouse, I believe it is divided between the two children.

Why are you concerned about this at this time...she just passed away, you wife needs support not someone worrying about her share which is the farthest from her mind right now. GROW UP!

Legally speaking, only if your mother-in-law left a will with your children as heirs, then yes it is correct. If not, it will be up to the morality of the aunts or uncles of your children. Check your local municipality or state law. Every state is different.

A will would dictate who got what. If there is no will it would go to the spouse by most state laws, I believe. Get on the web and find some legal advice.

Is your wife already dead, or are you just in the planning stages?

Why can't the body get cold before people put their hands out?
It will totally depend on the state you live in, if she had a will, and all that kind of stuff. Probate and taxes figure in. Just sit back and see if you get some.

See a lawyer. Your wife's estate might still be entitled to a portion of the inheritance. Did she have a will?

I think you should get a share of the money ,so you can put it towards your funeral ,like barn owl said you are already dead!
