It is vandalism because if I wanted my property painted, I would pay to have it painted.

I believe that it is an art... I have seen beautiful graffiti on buildings, rocks highways. These kids have an artistic side that they are being punished for expressing. It shouldn't be a crime and I bet you can start a business because a lot of business owners would love to have a flashy , colourful graffiti wall to show off their business and to help make it stand out more.

Graffiti is an art when it properly drawn in an area dedicated for art. However, if graffiti is drawn on walls of buildings, fences and public infrastructure it is a nuisance.

Take business owner out of your question. Do you own a car? A house? A bicycle? Would it be OK if I spray painted a gang symbol on your car?

Paint your stuff any color you want. Note, I said your stuff. Leave mine alone. I like it the way it is.

It's art if you spray paint YOUR wall or window. It's vandalism if you do it to mine; and you deserve jail time. End of story.
