I have been a good employee, but I work for bad people. I'm a sales men and just bagged a large acct that will pay me 20K in comisions.

My father had a bad accident and was in ICU for 18 days before he passed. I was with him at the hospital for about 15 days + 3 days for the funeral. This was in December. Now I broke out with Shingles (very painful) on my back and was out for 4 days under Doctors care in February.

As I said these guys are bad and I'm getting bad vibes. Why keep me and pay me the 20K commision for 4 years = $80K.

I am in Illinois and it is an at will state, meaning they can fire you whenever they want. I have no contract so I will lose that commision.

Is there anything I can do if I got fired for "no just cause" except my attendence for a death and sickness.

Ya, the easy answer is sue, but is there hope?

Legally, your job has to be kept for you for a maximum of 3 months if you take that much time off. if you are just randomly taking days off, then they have a right to let you go if they have a written policy into place... if not.. then no, they don't really have the right to do that. And if you can prove that you had legit reasons to be out then you can file a discrimination case against them, b/c I would say that your employer is bot being ethical.

They can fire you for anything they want to and they don't even need to give you notice or a reason. Try fighting through the labor board, but I doubt they will do anything since it isn't race, gender or any of that discrimination. Good Luck. Maybe doctor notes will help out.

I work in commissioned sales. A good salesperson is always an asset to an employer. Be a good salesperson. Be so good that only a total idiot would fire you. Be so good that they'll gladly give you a raise and beg you to take your time and get well and do more sales.

If you're that good, and they're stupid enough to fire you, don't hire a lawyer, go straight to their biggest competition and sell for them instead.

Caring for a family member is covered by the Family Medical Leave Act. If you have documentation for your person illness, you should be fine.

Being an at-will state, it sounds as if they need no such 'just cause' to terminate your position. Not only would I find another job, I'd find another state ;)

Actually I'd suggest going into business for yourself, but that's a whole other conversation. But feel free to contact me if you've considered such.

If you are continuing to have problems you should take a medical leave under the FMLA Act otherwise there is nothing you can do.

You do not state if you have union representation. If you do then file a grievance. If like Ohio you may not have much recourse. GOOD LUCK!!!
