Let's make this clear. There is no such thing a 2006 328i. There just isn't, it wasn't made that year. A 2007 does exist, its the current E90 and E92 vehicle. In 2006, you would be able to buy a 325i, 325xi, 330i etc.

Now, the question. This is tricky. Now, I have heard that the speed governor is set at 129 mph. But, if you get the sport package it is set to the "Gentleman's agreement" (set by the German Car companies) to be at 155 mph, this I am positive of.

This would lead one to believe that the standard (stock, factory-set) is set at 129 mph. I, however, currently have a 2000 (E46) 328i and have, frequently and recently gone 135 mph, significantly higher than the supposed 129 mph level. This being said, it is possible that the standards and practices have changed since the E46 Chassis, but I think that it may be unlikely.

Unfortunately the clod above me is quite correct in saying that the best way to find out is to try. Please do so in a safe way and before and after, monitor your tires and engine function.
