It varies by state, but I can say that in Iowa, it is not a moving violation.

In the state of New York it was considered just a violation 6 years ago. However the information does get sent to the DMV and the insurance company does find out about it. The 50 dollar fine was enough to get my husband to keep his seatbeat clicked.
Not sure if it's change in the last 6 years and how much the fines have gone up.

In most states it is now a moving violation. Originally, it was only to be a secondary violation, meaning that you could not be pulled over for not wearing a seat belt, but that has now changed in most places.

In NC, it is a $110 court cost & fine plus 2 pts on driver's license but no insurance pts. Law changed in 2006.
