Yes you can sue but you may not have to. They should have insurance to cover all the damage.

If the incident is a result of carwash equipment malfunction, MAYBE you can try to resolve something in Small Claims Court, although they do have signs that imply release of liability when something goes wrong.
However, if you got hit from behind by another vehicle, and your car was damaged because it fell into the drainage pit.. you're out of luck as far as the carwash guys go!
Blame the car behind you! Both YOU and the Carwash place might be able to take HIM to court! LOL.

Contact the car wash manager/owner first. ...Be nice...not an a..hole. They should be very willing to help out. I'm actually surprised you even drove away without talking to someone right then. If they don't want to help then your next recourse would be Small Claims Court....be ready to prove they did it though. Try and get an employees name that saw the accident or better yet another customer of the car wash to testify for you.

Putting up a sign that says you're not liable doesn't release you from liability any more than any more than putting up a sign that says "I'm a millionaire" makes you rich.
If the damage was caused by faulty equipment, yes, they can be liable.
Same story with dump trucks that have the sign on them that says "not liable for broken windshields". If their load isn't covered as required by law or they don't have tire flaps as required by law, yes, they are liable regardless of how many signs they have.

It sounds like you have a strong case, but I think most car washes have a disclaimer posted stating that they are not liable for any damages. You should contact a lawyer to get a second opinion.

I think you enter those automatic car washes at your own risk. Your insurance should cover some of the damage depending on your policy.

no every car wash has signs posted that they are not responsible for damage to vehicles. if there are no signs yes. man I would be pissed.

dont think there souposto fall apart .. i think you could sue for that
did you do a poilce report on it.... or did you tell the owners to fill out a report..
if you filed a report than that will help out alot..
