I hear that in the state of California a woman can name any man the father of her newborn baby on the birth certificate. So obviously whether or not i did have sex with her would be meaningless...my question is...If she puts my name down as father does that mean i am "the father" by default until proven otherwise. If so, how long do i have to dispute it until its written in stone that i am the father? Oh and how many attempts are made before its official...i mean as in how many letters are mailed or phone calls or whatever or does the child support take effect then thats when i find out that i need to dispute being a father.

Don't you think these questions should be asked of the California legal system, not yahoo answers?
I can't imagine that the things you heard are true, but there is only one way to get the legal answer, contact the legal people.

Well she can say that anyone is the father, and you will be listed as such but until you SIGN the birth certificate you are not legally the father. So if she says that you are, for child support, all you need to do is get a DNA test to show that you are not. And you will be removed from the birth certificate.

I live in California and as far as I know, a woman can only put your name down IF you also sign the birth certificate. Otherwise, she has to take you to court to prove you are the father before you can legally be declared the babies father.

I'm pregnant and married, but I am pretty sure even though we're married I can only put my husband down if he signs the certificate.

This woman COULD give the baby your last name, as she can name her baby whatever she wants, but you are not legally the father unless you sign the birth certificate or unless she proves it in court through DNA.

The best thing for you to do is immediately get a DNA test and if the baby is not yours then you need to have the courts take your name off the birth certificate oe else you will be responsible for child support.

I don't think so.I do not know the laws of California ,but in I'm pretty sure that the father has to sign the birth certificate to be considered the father.A guy could sign the birth certificate if the child wasn't his but if he did that the baby would be considered his child.
To know for sure contact the legal people.

If you are married it is assumed you are the father. Other than that you have to sign the birth certificate and declare you are the father or she has to go after you for a DNA test. She can't just say "it is him." They will require proof. Hope this eases your mind a little!

Wow, I think you need to be there to sign the birth certificate otherwise she has to take you to court to put your name on it and get child support. If you are married then it is assumed by law that you are the father. Don't quote me on this, I could be wrong. But good luck to you, hopefully you can prove her wrong without too much hassel.

get a paternity test now. If you never had sex with her, you're obviously not the father and to me it just seems silly that she could claim anyone as the father. If there is no DNA connecting you and the child, you have no legal responsibility towards the issure.

I don't know about in America but in Australia a father cannot be listed or named unless he has signed the birth certificate to acknowledge paternity. I don't think that you have anything to worry about, but as I said that is in Australia.

I live in Cali and yes she can put your name down. Look at all the bull going on with this Anna Nicole case. The best thing to do is request a DNA test.
