Ok, I have a way that I will be putting something on my product that is different from what is out there right now. Would that be something I could trademark. I believe it is, but not 100% sure. It is what makes my business stand out from others I believe that would be what a trade mark does. I am sure it isn't something I would copyright.

Hmm, without knowing further details it's hard to say. Is this "thing" part of the packaging? If so, a trademark may be possible.

Either way, it sounds as if you have something to protect that's slightly unconventional so I'd recommend contacting an intellectual property attorney.

What you probably want is a process patent.

But remember, a patent is only as good as your ability to sue some one in violation of that patent.

Patent attorneys are expensive, but you could do it yourself if you have the time and energy. Visit nolo.com from great guides (I am not a nolo employee, just a fan).
