A little background, i was completely stopped at a light, perfect road conditions, and the second are at the intersection, when a semi slammed into the back of me, (no horn honk to warn me or anything). It puched my car into the one in front of me, pretty much totalling my ride.

So i did the call the police thing and then called my insurance. The truck driver could not speak english and was on the phone with his superiors, who arrived on seen (two of them, both in BMWs) before the police.

The police simply gathered us around and we all told the same story, the cop said simple enough and wrote up the police report. this is where it gets strange. I asked the cop if the driver of the semi was going to get a ticket for failure to reduce speed to avoid an accident.....his answer No!
The trucking company reps. then offered the explanation that his brakes "failed" however on the accident report the semi was never towed and he was able to drive away with the same brakes.

The guy who hit you is responsible for all damages to both your car AND the car you hit. (I caused an accident like this myself) If the drivers insurance is jacking you around, GET AN ATTORNEY!

Carefully write down every single little detail of what happened. Do it now, while it is still fresh in your mind. Time of day, road conditions, what happened leading up to the accident, what happened during and after the accident, who was there. Everything you can think of. Get it down so you do not forget details. Next up, contact your insurance agent and tell them about what happened. Let them know so they can get their legal machinery in place. What may happen is that the person that you hit will come to you for damages. If no ticket was issued to the other company then they may be trying to figure a way out of the situtation. I do not know what exactly is going on but I would say let your insurance company know that you think something fishy is happening.

Also, get a copy of the police report as soon as possible. Also, did you get the insurance contact from the truck driver (or his bosses)? Share all of this with your insurance company. They have a lot better resources to deal with this situation and they have experience in dealings like this.

You need to tell all of this to the insurance company. If his brakes didn't work, he is breaking the law by driving a vehicle unfit for the road.

get a lawyer soon as possible..include (ALL) the info you can..includeing the name of the trucking company
