ok i have a question for anyone from that state. I'm living in tx and i have a friend who lost his son due to cps. the mother died in a car accident out of state after he was born. the child was taken from birth. now dad spent some years getting over some serious problems he was having and now wants to take back custody. the child is now 5 and he was only a year old the last time dad had a visit. he was adopted out and dad never signed the papers. i think he nuts wanting the kid now but i don't know if he can appeal it can he? and is dad wrong for wanting to take the kid away from what he knows?

If he was legally adopted then it is probably way to late. CPS always tries to find all parents or relatives involved. Obviously the father never kept in contact with cps or the child or there would have been a chance for the father to appear in court and contest an adoption. Cps probably had no address or way of contacting the Dad. It might be best if he thinks about what might be best for the child.

While I agree with Cindy H's answer, the U.S. Supreme Court has overturned adoptions that were done without the father's consent. My state has done the same. This could be devastating to the child. I'd suggest your friend try for visitation instead. However, your friend's consent was mandatory.
