We serperately 2 houses and then purchased 1 together. He has only made 1/2 payment on the together a couple of times and now he has not paid for 3 months. I am needing to refinance but want to get him off deed since he is not paying. Come to find out he is not paying on the other his either (even though he leased to own to someone). How can I get him off of my deed before he ruins my credit too?

Sounds like you need to buy him out and lose the deadbeat. Make sure you discount any potential "profit" splits by anything he hasn't paid that he should have, plus the transaction costs to refinance.

I don't know of anyway to force him to sign a release of interest in the property,he has a sweet deal now and to fix this a new contract would need to be written up. I would contact your loan finance company and see if you would qualify to refinance without him, if they say yes,then try to convince him that you will pay him "x"amount of dollars to end the relationship,and to get him to release interest on the deed. Good luck,I guess this is a hard lesson to learn. One additional note, if you plan to marry and own the property by yourself,I don't want to put a damper on ya,but don't refinance and add the husband. I learned the hard way that by doing this,you are providing that person with some unearned wealth,and when the divorce occurs,you can be forced to sell and split the profit,or many other scenarios. Basically,you are in the spot now,you just aren't married.
