Probably because no one had enough evidence to properly accuse him of murder, let alone get a conviction.

Law Enforcement was never able to bring a strong enough case for murder against Capone. Capone had Judges, prosecutors, and police on his payroll. Money can corrupt alot of people. I believe he paid alot of people in law enforcement to corrupt investigations and evidence in order to avoid more serious charges than the income tax evasion charges he eventually was convicted on.
In the end he died of syphylis in prison. A fitting end to one of the most ruthless of all criminals.
