That was because Bush lost 2 times at the US Supreme Court over Gitmo so he had a law passed, the Military Commissions Act of 2006 which tries to take away any authority over those who are within the confines of the US, and Gitmo, as a US military Bases is considered, and has always been considered, US Soil!

The president and Sec of Defense can declare any US citizen, under this act, a combatant, throw them in jail and they have no recourse to a civilian court as Bush eliminated habeas corpus and several Amendments to the US Constitution!

Time to revisit that Act! I e-mailed the Speaker of the House and I talked to my congresswomans office regarding that exact issue!

The civil courts have always avoided assuming military jurisdiction.
